Terms and Conditions

THESE TERMS

What these terms cover. These are the terms and conditions on which we supply products to you.

Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. By placing an order with Rosemullion Distillery Limited, you state your consent to be bound by these terms and conditions.

INFORMATION ABOUT US AND HOW TO CONTACT US

Who we are. We are Rosemullion Distillery Limited, a company registered in England and Wales. Our company registration number is 10941259 and our office is at Penperry, Old Church Road, Mawnan Smith Cornwall. 

How to contact us. You can contact us by using the contact details on the ‘Contact’ page on our website.

How we may contact you. If we have to contact you, we will do so by telephone, if you gave us your phone number, or by writing to you at the email address or postal address you provided to us in your order. “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

Our CONTRACT WITH YOU

Age and personal use. All persons ordering from this site must be 18 years of age or older and may not order for any persons under this age. By placing an order with us, you confirm you are over 18 years old. You also confirm you are purchasing our products for domestic use only.

How we will accept your order. Our acceptance of your order will take place when we email you our confirmation of your order, at which point a contract will come into existence between you and us.

If we cannot accept your order. If we are unable to accept your order, we will inform you of this in writing by email and refund your purchase price. We will send you email notification when such refund has been credited to your account. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

Your order number. We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

We only sell to the UK. Our website is solely for the promotion of our products in the UK. Unfortunately, we do not accept orders from or deliver to addresses outside the United Kingdom.

OUR PRODUCTS

Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.

PROVIDING THE PRODUCTS

Delivery costs. The costs of delivery will be as displayed to you on our website.

When we will provide the products. During the order process we will let you know when we will provide the products to you, subject to our carrier’s terms and conditions. Delivery is normally 2-3 working days

We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control, then we will not be liable for delays caused by the event. Your statutory rights remain unaffected.

Delivery Addresses

  • Double check the delivery address as you order.
  • Rosemullion Distillery Ltd is not accountable for incorrect information given to us and will pass on any incurred costs for a return or resend.
  • Change of address after it has been dispatched may incur a cost from the courier and be passed onto the customer.

Delivery Instructions / Suggestions

  • Use a work address where possible if nobody is going to be home.
  • Give instructions e.g. for parcels to be left with neighbours or we can leave the parcel at your risk in a porch, garage, back door etc without a signature. You must state this when placing the order.
  • If you are sending to another person, please send to their work address if possible and include a contact telephone number for them.

If you are not at home when the product is delivered. If no one is available at your address to take delivery and the products cannot be left securely, our nominated carrier company will provide instructions for redelivery to you.

If you do not re-arrange delivery. If after a failed delivery to you, you do not re-arrange delivery or collect them from our nominated carrier within a reasonable period of notice, the costs associated with such failed delivery have to be borne by you. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract.

When you become responsible for the products. Products will be your responsibility from the time we deliver them to the address you gave us for delivery.

When you own goods. You own a product which are goods once we have received payment in full.

Reasons we may suspend the supply of products to you. We may have to suspend the supply of a product to deal with technical problems or make minor technical changes; or update the product to reflect changes in relevant laws and regulatory requirements.

YOUR RIGHTS TO END THE CONTRACT

Instruction On Right Of Cancellation or Order amendment

If you wish to cancel the order, this must be done so before the order is dispatched from our warehouse. If the order has already been dispatched and left the warehouse you may incur return fees and loose the P&P charge. If the order is already in transit, we will do our best to stop it before being delivered, but if the courier can not stop before arriving then please refuse and return to sender (charges may incur).

In order to exercise your right of cancellation, you must inform us by way of unambiguous communication (e.g. by email) of your decision to cancel your order. You may submit your request of cancellation via email, or by contacting us,  via telephone.

If you wish to make an amendment to the order (address, add or remove items) then please call the office on 01326 702202 before the order has been dispatched.

IF THERE IS A PROBLEM WITH THE PRODUCT

How to tell us about problems. If you have any questions or complaints about the product, please contact us by using the details on the ‘Contact Us’ page on our website.

Your legal rights. We are under a legal duty to supply products that are in conformity with this contract. Nothing in these terms will affect your legal rights.

Exchanges & Returns

We are happy to exchange items if you are not 100% happy with the items where possible. Items to be returned and exchange must be in resaleable condition (not opened or damaged). The return and resending of an exchange may incur charges.

What should I do?

We ask that for either situation of a damaged or an incorrect item that has been sent that you take photographs immediately to be able to provide the team with the information they need to assess and resolve the issue. We ask that you report either issue immediately at the point of delivery or within 24 hours of the delivery.

Damaged Parcels

  • Here at Rosemullion we pack our goods with the upmost care and use quality packaging to ensure safe travels between our shop and the orders destination. In the occasion of a breakage please follow the below procedure.
  • Ensure all breakages or defects are reported within 24 hours of receiving the order.
  • Goods must be checked at time of delivery and any loss or breakage must be reported to the courier at the time of delivery. Damaged goods not noted at the time of delivery will be exempt from any compensation and refunds.
  • Contact us here at Rosemullion Distillery within 24 hours to report this to get assistance in resolving the issue.
  • If goods are damaged or broken, we will either give a full refund for the broken goods or arrange for another one to be sent out to you (stock permitting).
  • We will work with you the customer to resolve the issue and the correct action will be taken at our discretion.
  • If you notice something wrong at the point of delivery without opening it, please refuse the order and tell the courier to return right away.
  • Refunds will be made within 28 days.

Wrong Goods

If you have received an incorrect item on your order please let us know within 24 hours of receiving your order via email or by calling us on 01326 702202 – Monday to Friday 9am – 5.30pm We will be happy to help.

PRICE AND PAYMENT

Where to find the price for the product. The price of the product (which includes VAT and alcohol duty at the current rate) will be the price indicated on the order pages when you placed your order. We take all reasonable care to ensure that the price of the product advised to you is correct.

We will pass on changes in the rate of VAT and alcohol duty. If the rate of VAT and/or alcohol duty changes between your order date and the date we supply the product, we will adjust the rate of VAT and/or alcohol duty that you pay, unless you have already paid for the product in full before the change in the rate of VAT and/or alcohol duty takes effect.

What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any goods provided to you.

When you must pay and how you must pay. You must pay for the products on order before we dispatch them. We accept payment with Visa Debit, Visa Credit, MasterCard Debit and MasterCard Credit.

What to do if you think an order is wrong. If you think a price or order value is wrong please contact us promptly to let us know. You will not have to pay any interest until the dispute is resolved.

OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU

We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products including the right to receive products which are: as described and match information we provided to you and any sample or examined by you; of satisfactory quality; and for defective products under the Consumer Protection Act 1987

We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

HOW WE MAY USE YOUR PERSONAL INFORMATION

Please refer to the Privacy Policy for details about how we collect and use your personal information.

Age Restriction We can only sell alcohol products to those over the age of 18. By placing an order, you confirm that you are at least 18 years of age.

Pricing All bottles are 70cl or 25cl unless stated otherwise. Prices including VAT @20%.

Errors and OmissionsWe reserve the right to alter of change the prices within this site without prior notice, if an error has occurred.

Delivery We deliver to any UK Mainland address for £2.95 (for small parcel ,e.g. 1 large 70cl or 3 small 25 cl bottles) or £4.95 (for parcel of 2 or more large 70cl bottles or m 4 or more small bottles)

  • We charge £14.95 for deliveries to any Highland or Island addresses.
  • Unfortunately, we cannot currently deliver to Northern Ireland or addresses outside the UK
  • Orders placed will usually be despatched with 24hrs and arrive within 2 working days. 
  • Last order date for Christmas is midday on 18th December.

Returns, refunds and cancellations

  • If you notice something wrong at the point of delivery without opening it, please refuse the order and tell the courier to return right away.
  • Refunds will be made within 28 days for unopened product.
  • Contact your local depot as soon as you receive a ‘Sorry we missed you’ card.
  • If you do not contact the courier depot the parcel will be returned to us after 3 working days, the cost of which will be passed on to the customer. To re-send the parcel a further delivery charge may be required.
  • Delivery times are usually between 7am to 9pm.
  • The courier’s policy is to attempt delivery twice, if on the first occasion they are unable to deliver they will leave a card with the consignment number and branch telephone number. They will then attempt a delivery on the following day, if this fails you will have to collect the parcel from the depot.
  • Whilst we and our customers are very happy with our couriers of choice and their punctuality of expected days and delivery slot times given, we cannot be held accountable or accept liability for a late delivery if caused by circumstances outside of our or their control.
  • Any products must be returned to us in good condition and in the original packaging. All refunds will be paid within 14 days of receiving the returned product(s).

Returning Items

You are responsible for the cost of returning products to us unless the items being returned were delivered in error or the items were damaged or defective. You are also responsible for insuring all returns as we might claim against you should damages be sustained.

If you have received your order and have had a change of heart and wish to return the order, you can either return at your own cost and risk. Alternatively, we can organise a courier to collect from you at a cost that must be paid prior to collection or agreed to be taken off the refund price once received back.

  • Please return all items to: Rosemullion Distillery at the address above
  • Please ensure in the return there is a copy of your order with the item and reason highlighted for return. Please reuse packaging where possible, if sending back a part order add more padding to fill the void and ensure you are happy it will be returned safely. 
  • If a courier has been agreed to come and collect, ensure the above instructions are followed and the parcel is sealed ready for collection. The courier will provide and apply the label required for transit.

Secure Payments

Maintaining your privacy is a priority which is why we use Stripe Payment, a third party payment specialist. They are one of the largest independent payment processor in the UK 

Card Security

We won’t capture or store your card details and once you have entered your card number into a payment page securely hosted by Stripe payment, all sensitive data is encrypted and sent to the banks for processing. Once your transaction has been submitted, you will be automatically redirected back to our site where you will receive a confirmation regarding your order. 

Privacy Policy

We regard the privacy and security of the information which you share with us as very important and so have created this Privacy Policy so that you can understand the care with which we treat such information. By submitting information, visitors to the Rosemullion web site expressly consent to the use of such information as described in this privacy policy. If you enter the information which relates to someone other than yourself, you confirm that you have their express consent to our use of such information for the purposes set out in this Privacy Policy.  We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).

WHAT INFORMATION WILL WE BE COLLECTING?

We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. We will be able to collect and store information comprising the following:- name, address, telephone number, e-mail address, subscription requests, post code, age or age range. We will never collect sensitive information about you without your explicit consent.

WHO ELSE WILL HAVE ACCESS TO THE INFORMATION?

The information will only be accessed by own staff. The information will not be shared with other web sites to which links may be provided from our web site. We will not give, rent, sell or trade any of your information.

HOW IS THE INFORMATION USED?

We and our Advertising Consultants will use the information we collect to track and monitor the usage of our web site, the response to advertisements carried on our web site and help us understand the patterns of site visitors. This will help us operate the web site more effectively and also assist us in business processes such as accounting, marketing and record keeping.

We may use “cookies” form time to time. Otherwise known as a type of tracking software, a cookie is a small, unique text file that is sent to your browser from a web server and stored on your computer’s hard drive. Cookies will help our web site tailor the information presented to you based on your preferences by collecting information such as which areas of the web site you have visited and for how long, so the next time you visit the site, those pages may be readily accessible. Cookies will also allow us to collect statistical information such as countries of origin, search engines used, how many visitors download files and which files these were. We will also be able to study how visitors navigate around the site and this will help us manage and improve the site where necessary.

WILL I GET SENT INFORMATION THAT I DID NOT ASK FOR?

No, when you supply us with your e-mail address you choose what information you wish to receive. You will only receive information that you request using the subscription software.

HOW CAN I ACCESS MY INFORMATION?

You may request access to all your information that we collect on line and maintain in our database by contacting us.

WHAT ABOUT CHANGES TO THE PRIVACY POLICY?

We reserve the right to modify or amend this Privacy Policy at any time and for any reason. Details of any changes will be posted at the top of the Privacy Policy web page.
